Bright Starts Co. LLC Service Agreement and Consent Form
This Service Agreement and Consent Form (“Agreement”) is made effective as of the date of the last signature below, by and between Bright Starts Co. LLC, an Arizona limited liability company (“Consultant”) and [Parent/Client Name] (“Client”). By signing this Agreement, Client acknowledges and consents to the following terms and conditions for certain discipline consulting services provided by Consultant.
Nature of Services. Consultant will provide disciplinary consulting services to Client (“Consulting Services”). The Consulting Services provided by Consultant are consultative in nature and are not a substitute for therapy, medical advice, or psychological counseling. Consultant does not provide therapy or diagnose medical or psychological conditions. Consultant provides Consulting Services only. These Consulting Services do not constitute therapy, medical care, or mental health treatment. While Consultant’s principal holds a professional social work license, these Consulting Services are not provided under that license. Any advice, strategies, or resources are offered in the capacity of a consultant, and not as a licensed clinical provider. Client acknowledges that engagement in these Consulting Services does not establish a therapist-client relationship or other professional relationship. Consultant is not offering any professional services, and Client expressly agrees Consultant is not acting in any professional capacity, including medical, legal, financial or otherwise.
Consulting Services Details. The Consulting Services include:
  • One-hour consultation (via Kajabi)
  • One 30-minute follow-up session, to occur 4-6 weeks following consultation
  • Comprehensive needs assessment/questionnaire
  • Detailed discipline plan with follow-up notes, recommendations, and resources (if applicable)
Service Fee. The service fee (“Service Fee”) for all Services provided hereunder is Two Hundred and Twenty-Five Dollars ($225). Client will remit payment of the Service Fee using a credit card via Kajabi Payments  upon signing this Agreement and prior to scheduling the one-hour consultation. 
Roles and Responsibilities Parent/Caregiver. Client acknowledge and agrees that active participation and implementation of strategies discussed during sessions is imperative and is Client’s responsibility. Client agrees to provide open communication regarding progress and challenges to allow Consultant to best perform the Consulting Services.
Bright Starts Co. LLC’s Role. As part of the Consulting Services, Consultant will provide guidance, support, and tailored advice based on the needs assessment in the one-hour consultation and offer recommendations and resources without guaranteeing specific outcomes. All assessments and recommendations shall be made in the discretion of Consultant. Consultant shall use its reasonable best efforts to provide Consulting Services with a high degree of care, skill, diligence, professional knowledge, and expertise. All Consulting Services shall be performed in accordance with generally accepted industry standards and practices. Consultant does not guarantee specific outcomes but is committed to delivering quality and professional support tailored to Client’s needs.
Confidentiality. Consultant upholds the highest standards of confidentiality. However, Client acknowledges that confidentiality may be breached under the following circumstances: (i) suspected child abuse or neglect; (ii) risk of harm to the Client, children, or others, (iii) ;egal requirements or court orders. Consultant complies with all Arizona mandatory reporting requirements under A.R.S. §13-3620. In the event of suspected child abuse, neglect, or immediate harm, confidentiality may be breached as required by law. Furthermore, Client agrees to keep confidential all materials, ideas, concepts, and Consulting Services provided by Consultant.
Cancellation Policy. Cancellations or reschedules of any sessions/consultations made with less than 24 hours' notice will result in a charge of 50% of the Service Fee. No-call/no-show appointments will result in 100% of the Service Fee being charged.
Testimonials and Feedback. Client acknowledges that they may be invited to provide testimonials, feedback, or participate in promotional activities for Consultant. By agreeing to provide such materials, Client grants Consultant a perpetual, irrevocable, royalty-free license to use, reproduce, and publish these materials in any format, including but not limited to websites, social media, or advertising materials. Consultant will not disclose personal identifying information without Client’s prior written consent.
Client Consents and Acknowledgements. Client acknowledges and agrees:
Consultant may use technology, including video conferencing and digital documentation, in the provision of Consulting Services. Clients is aware of inherent risks associated with technology use, such as data breaches or unauthorized third-party access.
Sessions may be recorded for quality assurance and training purposes. Client hereby consents to recording for such purposes.
Although Consultant’s principal holds a social work license, these Consulting Services are conducted exclusively in a consultative capacity and not under the authority of the Consultant’s license. The Client understands that the Consultant is not providing therapy or any form of mental health treatment.
Client affirms that they are the parent or legal guardian authorized to consent to Consulting Services. Consultant does not provide Consulting Services to minors without parental or legal guardian involvement and consent.
Consultant does not provide emergency services. In the event of a crisis or mental health emergency, Clients are instructed to contact 911, a licensed therapist, or a crisis hotline immediately. Consultant is not responsible for addressing or managing emergencies.
Client acknowledges and agrees that they assume all risks associated with implementing any advice, strategies, or recommendations provided by Consultant. Client is solely responsible for evaluating and deciding whether to follow Consultant’s recommendations and understands that outcomes may vary based on individual circumstances and effort. Consultant is not liable for any physical, emotional, or financial harm resulting from the application of its recommendations.
Intellectual Property. All materials, discipline plans, and resources provided by Consultant are proprietary and protected under applicable intellectual property laws. Consultant grants Client a limited, non-transferable, non-exclusive license to use these materials solely for personal, non-commercial purposes related to the Consulting Services. Duplication, distribution, or reproduction of these materials without Consultant’s prior written consent is prohibited. Consultant reserves the right to revoke this license in the event of unauthorized use.
No Guaranteed Outcomes. There is absolutely no guaranty of any outcome as a result of participating in or receiving the Consulting Services. Client understands that outcomes of the Consulting Services can be subjective and can vary greatly depending upon individual circumstances and individual effort invested in the process.
Termination of Services. Consultant reserves the right to terminate Consulting Services at any time if it is determined that the client is not benefiting from the consultation, is uncooperative, or fails to comply with the agreed-upon strategies. Client will be notified in writing of any termination of Consulting Services.
Communication; Scheduling. Consultant does not engage in social media communication regarding client services. All official communications will take place via email. Consultant may, in its reasonable discretion, engage in email communication with Client between the consultation and the follow-up session on an as-needed basis to be determined by Consultant. Responses from Consultant may take up to 48-hours. All consultations and sessions will be scheduled via HoneyBook. In the event Consultant must reschedule a consultation or session due to reasons outside of Consultant’s control, Client agrees to work with Consultant to reschedule. 
Non-Disparagement. Client agrees that, unless required to do so by legal process, Client will not make any disparaging statements or representations, either directly or indirectly, whether orally or in writing, by word or gesture, to any person whatsoever, about Consultant or its management, employees, independent contractors, agents, contributors, sponsors or representatives, which includes any public review or post on any social media platforms and internet searches. For purposes of this section, a disparaging statement or representation is any communication which, if publicized to another, would cause or tend to cause the recipient of the communication to question the business condition, integrity, competence, good character, or product quality of the person or entity to whom the communication relates. 
Force Majeure. Consultant shall not be liable for any delay or failure to perform its obligations under this Agreement due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, or other unforeseen circumstances. In such an event, Consultant will notify Client as soon as practicable and will use reasonable efforts to resume Consulting Services as promptly as possible.
Limitation of Liability. To the fullest extent permitted by law, Consultant shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to this Agreement, even if Consultant has been advised of the possibility of such damages. Consultant’s total liability under this Agreement shall not exceed the total fees paid by Client for the Consulting Services.
Indemnification. Client agrees to indemnify, defend, and hold harmless Consultant, its members, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: Client’s use or implementation of any advice, strategies, or recommendations provided by Consultant, any breach of this Agreement by Client; or any negligent or willful acts or omissions by Client.
Dispute Resolution; Governing Law. Any disputes arising from this Agreement shall first be subject to mediation. If mediation is unsuccessful, the dispute will proceed to binding arbitration in accordance with the laws of the State of Arizona. Both parties agree to waive the right to a trial by jury. This Agreement will be governed by the laws of the State of Arizona.
Entire Agreement.  This Agreement constitutes the sole and entire agreement of the parties with respect to the subject matter of this, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the subject matter.
Amendments No amendment, changes or modification to this Agreement shall be valid unless it is in writing signed by both parties. 
Execution. This Agreement may be executed by an electronic signature that shall be fully binding. 
Electronic Signature. By checking the box at checkout you affirm that you agree to these Terms and that your electronic signature is legally binding.
